Elite Tennis Coaching terms and conditions
Elite Tennis LA LLC, also operating under the name Elite Tennis Coaching (collectively referred to as “we,” “our,” or “us”), provides tennis coaching, court rentals, and related services. By accessing or using our services, clients agree to comply with the following Terms and Conditions:
1. Service Provision
Elite Tennis LA LLC is committed to offering high-quality tennis coaching and related services. All bookings must be made through our club’s web resources or by phone. Web resources include our official website, booking page, and any official social media forms, such as those on Instagram or Facebook.
Only bookings confirmed via email from a mailbox with the domain elitetenniscoaching.com are considered legitimate and authorized by the club. The club is not responsible for any bookings made or accepted through other sources.
Services are provided for the exact time booked, with no exceptions, except as specified in point 5.
2. Assumption of Risk and Release of Liability
In consideration of the opportunity to participate in or access the services provided by Elite Tennis LA LLC, clients hereby release and covenant not to sue the company, its owners, employees, instructors, agents, and all others involved, from any and all present and future claims resulting from ordinary negligence on the part of the company or those listed, for property damage, personal injury, or wrongful death arising out of the use or intended use of the facilities, services, and/or equipment, or participation in any sport or non-sport activity incidental thereto, wherever, whenever, or however such incidents may occur.
Clients voluntarily waive any and all claims resulting from ordinary negligence, both present and future, whether known, anticipated, or unanticipated, that may be made by the client, their family, estate, executors, administrators, heirs, or assigns. It is acknowledged that using the facilities, services, and/or equipment involves inherent risks, including the risk of accidents, minor or severe injury, and even death. These risks may include, but are not limited to, heart attacks, serious neck and spinal injuries resulting in paralysis, and injuries to bones, joints, muscles, and internal organs. Safety equipment provided may be inadequate to prevent serious injury.
3. Awareness of Risks
Clients understand that participating in the activities offered by Elite Tennis LA LLC involves additional risks, such as traveling to and from activity sites, participating at locations that may be remote from medical assistance, and the possibility of reckless conduct by other participants. Clients willingly assume these risks and accept full responsibility for any and all property damage, personal injury, or death that may occur as a result of their participation.
Clients further agree to indemnify and hold harmless the company and others listed for any and all claims arising from participation in or receiving instruction in any of the activities or activities incidental thereto, whenever, wherever, or however they may occur. Clients represent that they are in good physical condition and will only engage in activities for which they are physically fit to participate.
4. Payment Processing
All online payments are processed through Stripe. Elite Tennis LA LLC does not store or have access to clients’ full payment information. Stripe handles all online payment transactions in accordance with its own privacy policy and terms of service.
Clients may also provide tips to coaches, either through direct payment or added during the booking process. Tips are voluntary and not required.
In addition to online payments, clients may also choose to make payments in person (cash) or by direct bank transfer. These alternative payment methods are accepted on a case-by-case basis, and clients should coordinate with the club for further details.
5. Cancellation and Refund Policy
Clients must notify Elite Tennis LA LLC of cancellations or rescheduling requests at least 24 hours before their scheduled session. Refunds will not be provided for cancellations made within this period. However, if the absence is due to a cataclysmic event (such as a severe storm or other natural disaster), the session may be reconsidered for a refund or rescheduling.
If no other sessions are scheduled on the same court after the missed session, a 15-minute extension may be offered as a goodwill gesture, but this is not guaranteed.
6. Data Privacy and Security
Elite Tennis LA LLC values client privacy and is committed to protecting personal information. Cookies and usage data are also collected to improve the website experience. All personal data collected is handled responsibly. For bookings and scheduling, Elite Tennis LA LLC uses SimplyBook.me and other service providers as deemed necessary to provide better services. Such providers process personal data according to their Privacy Policy.
Elite Tennis LA LLC is not responsible for the actions of other service providers with respect to personal data. Clients agree not to hold us liable for any mishandling of personal data by third-party providers.
Clients have the right to request access to, correction of, or deletion of their personal data held by Elite Tennis LA LLC at any time. Additional terms may apply regarding privacy, which are detailed in the separate Privacy Policy agreement.
7. Legal Agreement and Governing Law
This agreement is intended to be as broad and inclusive as permitted by the laws of the State of California. If any portion of this agreement is found invalid, the remainder will continue to be in full legal force and effect. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Los Angeles County, California.
By using our services, clients affirm that they are of legal age and freely agree to these terms. They acknowledge that by agreeing to these terms, they are giving up certain legal rights and/or remedies that may be available for the ordinary negligence of Elite Tennis LA LLC or the parties listed above.
Clients who are under the age of 18 may only use our services with the agreement and responsibility of a Parent/Guardian. In such cases, the Parent/Guardian assumes all responsibilities and liabilities for the minor’s participation and adherence to these terms.
8. Amendments to Terms
Elite Tennis LA LLC reserves the right to update or modify these Terms of Use at any time. Any changes will be posted on our website, and clients are encouraged to review the terms periodically.
